These Terms of Use govern access to and use of the website runaria.aiand its related domains (the "Site"). By using the Site, the user fully accepts these Terms. The Site is intended to provide information about and present the ARIA product and related services.
1. Site operator
The Site is operated by evoseed S.r.l., registered office at Via Lucrezio 13 — 34134 Trieste (TS), Italy, VAT/Tax ID 01361650326, REA TS-208336 (the "Operator"). ARIA is a solution developed by evoseed S.r.l. and part of the OptiWize ecosystem.
2. Purpose of the Site
The Site provides information about the ARIA product and allows users to request a demo, submit contact requests and apply to become a partner. Information on features, plans and prices published on the Site is purely indicative and does not constitute a public offer. The provision of the ARIA service is governed by separate contractual agreements entered into between the parties.
3. Interactive demo
The Site may include an interactive demo for illustrative purposes. Such demo is an illustrative simulation: the scenarios, outputs and commands shown are pre-defined and are not connected to any real network infrastructure. Demo results do not constitute a warranty of the product's actual performance in a production environment.
4. Intellectual property
All Site content (text, graphics, logos, trademarks, images, code, layout) is owned by the Operator or the respective owners and is protected by applicable intellectual and industrial property law. The trademarks "ARIA", "OptiWize" and "evoseed" and related distinctive signs may not be used without prior written authorisation. Reproduction, distribution or modification of the content without the Operator's consent is prohibited, except for personal, non-commercial use.
5. Acceptable use
The user undertakes not to:
- use the Site for unlawful purposes or in breach of these Terms;
- attempt to gain unauthorised access to systems, data or restricted areas of the Site;
- introduce malware or interfere with the proper functioning of the Site;
- collect other users' data or carry out unauthorised scraping;
- submit, through the forms, false, defamatory content or content infringing third-party rights.
6. Limitation of liability
The Site is provided "as is". The Operator takes reasonable measures to ensure the accuracy and availability of the content but does not warrant that the Site is error-free or always available. To the extent permitted by law, the Operator is not liable for any direct or indirect damages arising from the use of, or inability to use, the Site, or from reliance on the information it contains.
7. Links to third-party sites
The Site may contain links to third-party websites. The Operator does not control and is not responsible for the content, policies or practices of such sites, which are accessed at the user's sole responsibility.
8. Processing of personal data
The processing of personal data collected through the Site is described in the Privacy Policy and the Cookie Policy, which form an integral part of these Terms.
9. Changes to the Terms
The Operator reserves the right to amend these Terms at any time. Changes take effect upon publication on the Site. Continued use of the Site after publication constitutes acceptance of the changes.
10. Governing law and jurisdiction
These Terms are governed by Italian law. The Court of Trieste shall have exclusive jurisdiction over any dispute relating to the interpretation, performance or validity of these Terms, without prejudice to any mandatory jurisdiction of the consumer's forum where applicable.
